Divorce Timeline: What Happens Month by Month

A realistic month-by-month view of an uncontested divorce, from the decision to file through the final decree.

Seeing a divorce as a timeline instead of a cloud of uncertainty makes it far less intimidating. Here's how an uncontested divorce typically unfolds.

Before you file: the agreement

The most important work happens before anything is filed: you and your spouse talk through the money and the children and reach agreement. Take the time you need here, a solid agreement makes everything after it smooth.

Month 1: filing and service

You prepare and file your petition, pay the court fee, and formally notify your spouse. In an uncontested case your spouse signs a waiver accepting service, and the clock on your state's waiting period starts.

The waiting period

Depending on your state, you now wait, from a few weeks to about six months, while the paperwork moves through the court. There's usually nothing to do but stay on top of any documents your court requests.

Finalizing

Once the waiting period passes, a judge reviews and signs your final decree. Some states require a brief hearing; many don't. You get certified copies, and you're officially divorced.

The exact months vary by state, but the shape is always the same: agree, file, wait, finalize. We map your specific state's timeline for you when you start.
